Patent and copyright infringement cases proceeding against the federal government are brought before the U.S. Court of Federal Claims. These cases differ dramatically from those involving only private parties. For example, the Court of Federal Claims cannot enjoin patent infringement by the federal government and monetary awards are limited to a reasonable royalty!
Judge Damich’s presentation will not only cover the above, but also the long and storied history of infringement suits against the government, government contractor immunity, intriguing statutory anomalies, and issues of classified information.
